The Clerk to the Case
The clerk to the case supports and advises the Division on points of law and procedure.
They are responsible for the smooth running of the case, for co-ordinating attendees on the day and for taking notes of the proceedings.
The clerk will come to talk to you in the discussion room to deal with any matters or questions that arise on the day, and will collect you when the hearing is going to start.
The clerk writes up the reasons for the Tribunal's decisions in a draft Judgment which the Members of the Division amend and approve before signature by the Chair on behalf of the Division.
Go to the Court RoomLegal Representative
Applicants and Respondents may choose to have legal representation at the hearing, although the Tribunal does not provide or pay for legal representation.
Where the Applicant is the Solicitors Regulation Authority (or 'SRA'), which is the regulatory body for solicitors in England and Wales, the proceedings will usually be conducted by in-house solicitors and barristers appointed by the SRA or by solicitors in private practice appointed by the SRA. The SRA's solicitors may instruct barristers to appear on their behalf at the hearing.
Respondent
The Respondent is the person (or persons) against whom allegations have been made and who is (or are) appearing before the Tribunal.
